    Central FSSAI License:

    What is FoSCos / FSSAI Food License?

    FSSAI launched Food Safety Compliance System (FoSCoS) wef 1st June 2020 replacing existing Food Licensing and Registration System.Food License Registration certificate is required to run a food product business.     The Food Safety and Standard Authority of India (FSSAI) takes the matters related to the production and processing of food seriously. There is Section 50 to Section 65 that deals with the offenses under the FSSA 2006. It keeps track of all the necessary requirements that one needs to abide by and follow the compliance policy to avoid bing punished. The basic offence is the sale of food without the FSSAI licence for which one can be punished with imprisonment and a penalty of about 5 lakhs. Some of the other offences are:

    The sale of substandard quality of food is considered as an offence under the FSSAI regulations and a penalty of 5 lakhs is to be paid.

    The sale of misbranded products is punishable with a penalty of 3 lakhs.

    The production, processing and storage of food with unethical means is punished with a penalty of 1 lakhs.

    The production, processing and storage of food with unhealthy means is punished with a penalty of 1 lakhs.

    There is also a penalty of 5 lakhs if the person suffers because of low quality food.

    The individual who fails to rectify their mistakes will be faced with shutting down of the business and cancellation of license.

    What are the documents required for the FSSAI License?

    There are various documents that are required depending on which type of FSSAI License are you applying for:-

    Step by Step guide of the Registration Process:

    The procedure for obtaining different food licenses is different. Let’s see each in detail:-

    Basic Registration

    Your login ID will be created after the concerned authority verifies all your documents, after which you must submit a duly filled out Form A along with the prescribed fee for approval. According to the location of your business the license will be granted with a 10-15 days window.

    • State License

    Once your documnets are verified by the concerned authority, next your login ID is created. With the specified Form, a special document called a ‘Declaration’ must also be submitted to obtain a State License. The ‘Declaration’ also contains the general declaration statement of the operator along with the specified Form 9 and the Proclamation of Food Safety License Management System FSMS based on the type of business the operator operates.

    • It is necessary to file Form B with the documents. Depending on the location of yor business, you will get your licencse within a 20-30 days window.
    • In case of an error or fault in your application or documents, it is a must to rectify the errors and submit it again within 30 days. Else your application will be rejected and you will have to start the process all over again.

    Central License

    • The procedure to receive a State License

    is the same as the procedure of obtaining a Central License . The only difference is which type of food business is being operated by the FBO. The time taken is similar as well.

    • Regardless of the turnover of the business, if the food business exports or imports food items, an IEC, or Import Export Code, is required. As well, if the food business involves the transportation of food items, to specify the food production the FBO is involved, Central License if required.

    FSSAI Annual Return Online Safely from Home

    “All Food Business Operators (FBOs) who possess food license and have an annual turnover of Rs. 12 lakh should file the annual return mandatory and within the due time. If anybody fails to file the returns within the stipulated time period, he may have to face grim penalties.

    Every FBO’s who possess FSSAI Food License should submit their return if they have an annual turnover of Rs.12 lakh. Failing to file the return within given time shall face penalties. They should be mandatory to file their Half- yearly Return by 30th September/30th March and Annual Return by 31st May.”

    Who is Eligible to File FSSAI Annual Return?

    Every Business involved in food manufacturing, import, and export of food products or selling is required to file for the FSSAI annual return. Also, those who are involved in the manufacturing and distribution of dairy products should file for a half-yearly return.

    What is the FSSAI Form-D1?

    “FSSAI Form D1 as defined by the Food Safety Commissioner is made mandatory for the Food Business units who are involved in manufacturing, importing, labelling, packing, re-labelling, and re-packing irrespective of the production they are involved with.

    The FSSAI Annual Return-Form D1 should be filed on or before 31st May in every fiscal year. However, the form is filed with the Licensing Authority depending upon the type of food products sold by the FBO in the preceding financial year.

    What is the FSSAI Form-D2?

    FSSAI Form D2 is filed by the licenses who are involved in the manufacturing and distribution of milk or milk products. Whereas, Form D2 is filled from 1st April to 30th September and from 1st October to 31st March of every financial year.
